JAV: Representative of Youth Law


Healthy relationship between company’s management as well as the employees is the most important attribute as well as the open secret towards the success of any corporate. It is essential for the management to understand the requirements of the workers and help them in every way, just the way it is important for the employees to acknowledge the needs and targets of the company. Understanding this there are various companies who introduce the concept of work council in their company so as to establish a bridge between the employees and the employers.


There are specific guidelines, to be under the scope of work council, and that is the employee cannot be within the age group of 18-25 years and especially those who are trainee of the company. But ideally speaking the apprentice and trainee are also employees of the company with the same needs like other workers. They also need to communicate with the management regarding their rights and provisions, their requisites and demand, but the work council fails to help them. It is only then that JAV came into existence. JAV is an electoral body based on the German Industrial Constitutional Law where it works in same pace as that of the work council and shares the same rights regarding making suggestions or pulling decisions for the youth. It is the duty of this institutional body to look after the proper maintaining of youth labor laws and if required to take measures regarding executing them. It is the duty of JAV to look after issues of wage management for the youth, allowances, leaves, vacation or if it is matter related to working conditions. Though JAV is not equal to work council but obviously they have rights to speak on these matters.


The election of JAV occurs with active participation of all trainees and apprentices of a company. Usually the election for this position happens once in two years. Though there is a chairman and a vice chairman elected by the voting of all, but still there is no restriction and all trainees have the right to participate and share their thoughts and ideas. However with so many advantages, JAV has one disadvantage and that is its existence which is depended on work council. The work council looks after the employees whereas the JAV on the other hand represents the youth genre of the company. It is the voice with an identity among the larger number of employees which can be never be ignored by the management.
